The Bottle Store: Payment & Delivery Terms and Conditions

These Terms & Conditions govern your use of the The Bottle Store mobile app. Please read them carefully as they affect your rights and liabilities under the law. If you do not agree to these Terms & Conditions, please do not use The Bottle Store mobile app.

Any use by you of the app is conditional upon your acceptance of these Terms & Conditions, including our Privacy Policy. We reserve the right to amend these Terms & Conditions from time to time without notice and at our discretion. It is your responsibility periodically to review this page for updates to these Terms & Conditions, which shall come into effect once posted. Your continued use of the app will be deemed acceptance of these Terms & Conditions, including our Privacy Statement.

1. We will at all times adhere to any legal restrictions imposed on us in connection with the sale, and the offering for sale, of alcohol. Sales will only be made to those who have stipulated to being over the age of 21, and being legally permitted to purchase alcohol.  Proof of age and identity will be required before the delivery is handed over to you.

2. When you register on the Site you have been or will be required to provide certain information and register a username (Email ID) and password for use on this Site. On registering on the Site, you agree that you are responsible for maintaining the confidentiality of, and restricting access to and use of, your account and password, and accept responsibility for all activities that occur under your account and password. You agree to immediately notify The Bottle Store of any unauthorized use of your password or account or any other breach of security. In no event will The Bottle Store be liable for any direct, indirect or consequential loss or loss of profits, goodwill or damage whatsoever resulting from the disclosure of your username (Email ID) and/or password. You may not use another person’s account at any time. You agree to indemnify and defend The Bottle Store for any improper, unauthorized or illegal use of your account by you or by any person obtaining access to the app, services or otherwise by using your designated username and password, whether or not you authorized such access

3. By clicking on the order form purchase confirmation button ( or equivalent), you will be submitting an order which will incorporate all these Terms & Conditions.

4. We reserve the right not to accept your order, in which case we will not have any further obligation to you.

5. We may accept the whole or part of your order, both in respect of the kinds of products ordered and the quantity of products ordered. The price and invoice will be amended accordingly. If payment has been made in advance refunds will be arranged accordingly.

6. When you have completed your order you will be sent an e-mail confirming your order. It will state what the products/services are, the cost, delivery and invoice details and the scheduled delivery date and time. If your order has been unsuccessful you will be made aware of the reason why and any possible explanations.  Even if we accept your order, there will not be any agreement between us if you are under the age of 21 or not legally permitted to purchase alcohol.

7. If for any reason beyond our control, we are unable to supply a particular product of your order, we will notify you by SMS, phone or email as soon as possible. If a product is unavailable, you will be notified prior to delivery and where possible offered an alternative choice. If the alternative product is not accepted you will be offered a refund for the unavailable product(s). We will then process your order as per procedure. 

8. This service is only available in the emirate of Abu Dhabi, United Arab Emirates. Any orders received from other emirates or countries will be cancelled and a full refund provided. 

9. We accept payment via card online or card on delivery. This app uses the secure Magnati payment gateway to process payments online. No credit/debit card details are held by The Bottle Store.

10. There is no minimum order value. Free delivery is available on all orders over AED 100. Orders below AED 100 will incur an AED 15 delivery charge. (Selected Areas in ABU DHABI)

11. Our obligation is to deliver the products at the delivery address you have specified in your order to the person that placed the order who is over the age of 21 and is legally permitted to purchase alcohol. Proof of age and identity will be requested.

12. Our hours for delivery are 9am- 11:30pm seven days a week.

13. Upon placing your order a delivery date and time will be provided. If the time must be changed by us due to extenuating circumstances you will be informed by phone call, email and SMS. If the rescheduled delivery time is not suitable for you a full refund will be offered. 

14. You may cancel an order by calling our customer service number on +971 2816 4000. Where we have incurred costs due to late cancellation once the order has left our depot (you will be fully informed via the app when an order leaves the depot and is out for delivery), The Bottle Store has the right to charge you to recover the delivery costs as agreed while accepting the order. 

15. Deliveries will only be made to private residences in the emirate of Abu Dhabi, United Arab Emirates. 

16. If you are not available when we arrive to deliver your order we will contact you by phone or email to arrange. If no response is received in 24 hours your order will be cancelled and a full refund will be issued. 

17. We will not have any responsibility or liability for the non-delivery of any products unless either a) the products charged for are not delivered, or b) you give us full details of the shortages within 24hrs of the part delivery.

18. Our total liability to you for the non-delivery of any products is limited to delivering the products to you within 7 days of you informing us about the non-delivery. We reserve the right to substitute a product of equal or higher value in the event of supply shortages. Vintages may vary from those shown. If the substituted product is not accepted a full refund will be offered.

19. Suppliers may change bottle type, size, vintage and labeling at any point with no prior notice. Whilst we endeavour to ensure all images are correct and up to date in the website we cannot guarantee the bottle type, size, vintage and labeling when a product undergoes a change or changes. In an instance where the product may differ from the image, the customer can request a replacement or refund if they are not satisfied.

20. We will not have any responsibility for late or non-delivery of goods arising from incorrect delivery information being provided

21. The Bottle Store does not offer refunds or exchange on any purchases once delivery has been fulfilled unless the customer identifies an issue with the product. In the case of any quality issues with the product, we are happy to make an exchange only after official examination of the product by the management.

22. We will not have any responsibility or liability in connection with any defects in the quality of products purchased on our app unless we are provided with full details of the defects within 7 days from delivery.

23. To the full extent permitted by applicable law, we will not be liable to you or any third party for any consequential or incidental damages or any other indirect, special or punitive damages whatsoever that arise out of or are related to The Bottle Store mobile app.

24. We will endeavour to ensure that all pricing information on this website is accurate. In the event that we discover a pricing error we will contact you and ask you whether you wish to cancel your order or continue with the order at the correct price. We will not be obliged to supply goods at the incorrect price. 

25. We reserve the right to adjust prices, offers, goods and specifications of goods at our discretion at any time before (but not after) we accept your order. Where an end date is specified on any promotion on the website, it is intended as a guide only. We reserve the right to change prices at any time.

26. We reserve the right to remove promotional pricing at any time. Individual promotions may have specific, additional terms and conditions attached to them. All promotions must be delivered within 7 days of placing the order unless further details are stated on the specific promotions terms and conditions.

27. There will be instances where a price online does not match the price in a store. Prices and product availability are subject to change without any prior notice and we reserve the right to offer different prices on different channels.

28. We reserve the right to terminate you using our services at any time, for whatever we consider misappropriate or improper use or not abiding by these terms and conditions or if required by the law or the competent authority. You will be informed of such termination in writing.

29. In the event you have a complaint, please contact our customer service team on [email protected] giving full details of the incident. We aim to review and resolve all incidents raised within three working days. Any further delays to this time will be informed.
